About us

This website is operated by Discount Shack Pty Ltd (ABN 34 064 543 513) ("Discount Shack", "we", "us"). These terms apply to all orders placed through discountshack.com.au. By placing an order you agree to these terms. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy implied by law (including the Australian Consumer Law) which cannot lawfully be excluded.

Orders and acceptance

  • Placing an order constitutes an offer by you to purchase the products at the prices displayed. Each order we accept forms a separate agreement.
  • We accept your order when we email your order confirmation or dispatch the goods, whichever comes first.
  • We may decline or cancel an order (with a full refund) where: an item is out of stock or cannot be supplied within a reasonable time; there has been a website error, including an obvious pricing or description error; we cannot verify payment; or an event beyond our reasonable control prevents supply. If we cancel because of a pricing error, we will offer you the chance to reorder at the correct price where stock allows.

Prices and payment

  • All prices are in Australian dollars and include GST. A tax invoice is provided with every order.
  • We accept Visa, Mastercard and PayPal. Payment is taken in full at checkout.
  • Prices may change at any time without notice, but changes will not affect an order we have already accepted.
  • Promotional discount codes: one code per order, not redeemable for cash, and may be withdrawn or varied at any time. Codes cannot be applied to an order after it has been placed.

Stock and product information

  • Stock availability is indicative and cannot be guaranteed; items may be withdrawn from sale without notice.
  • We take care to describe products accurately. Product images are for illustration; packaging may vary. Video game classifications (ACB ratings) are shown on each product page — it is your responsibility to ensure a game's classification is appropriate for the person who will play it.

Delivery, risk and title

  • Delivery timeframes are estimates only — see our Shipping Policy.
  • Risk in the goods passes to you on delivery. Title in the goods remains with us until payment has been received in full in cleared funds.

Returns

Returns and refunds are handled under our Return and Refund Policy and the Australian Consumer Law.

Intellectual property

All content on this site (text, images, logos and design) is owned by or licensed to Discount Shack and may not be reproduced for commercial purposes without our written permission. Game titles, artwork and trademarks belong to their respective publishers and are used for the purpose of selling genuine physical products.

Liability

To the extent permitted by law, we are not liable for indirect or consequential loss (including loss of profits, revenue or data) arising from your use of this website or any order, and our total liability in connection with any order is limited to the amount you paid for that order — except that nothing in this clause limits your rights under the Australian Consumer Law, and in respect of goods our liability for a breach of a consumer guarantee is limited (where permitted by law) to the replacement or repair of the goods or the cost of replacement or repair.

General

  • These terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales.
  • If any part of these terms is found to be unenforceable, the rest remains in effect.
  • We may update these terms from time to time; the version published at the time you order applies to that order.
